1. Acceptance of Terms

By accessing or using Palmetto Rain (“the Service”) at palmettorain.com, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We may update these terms from time to time; continued use after an update constitutes acceptance.

2. Description of Service

Palmetto Rain is a web-based yard and garden intelligence tool designed for South Carolina homeowners. The Service uses local rainfall data from the NOAA National Weather Service combined with your yard profile to generate watering recommendations, track water savings, and deliver email summaries.

Watering recommendations are estimates based on publicly available weather data and general horticultural guidelines. They are not a substitute for professional landscaping or agricultural advice. Actual water needs vary based on soil type, microclimate, plant health, and other factors we cannot measure.

3. Account Registration

You must create an account to use the Service. You agree to provide accurate information and keep your credentials confidential. You are responsible for all activity that occurs under your account.

You may delete your account at any time by emailing will@palmettorain.com with the subject line “Delete my account.” We will permanently remove your data within 30 days.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other user accounts, our database, or any part of our infrastructure.
• Scrape, crawl, or systematically extract data from the Service without our express written permission.
• Submit false or misleading information during account setup or onboarding.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to suspend or terminate accounts that violate these terms.

5. Emails and Notifications

By creating an account, you may receive transactional emails related to your account (e.g., welcome messages). Daily watering reminders and weekly summaries are opt-in and can be disabled at any time in your Settings, or by clicking the unsubscribe link in any email. We will never send marketing emails on behalf of third parties.

6. Intellectual Property

The Palmetto Rain name, logo, visual design, and original content (including the plant library and recommendation algorithms) are owned by Palmetto Rain and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Data you provide (watering logs, yard profile) remains yours. You grant us a limited license to use it solely to operate and improve the Service.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that NOAA data will always be available or accurate.

8. Limitation of Liability

To the maximum extent permitted by law, Palmetto Rain and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to plant damage, property damage, water bill overages, or data loss, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim (which, for free accounts, is zero).

9. Service Changes and Termination

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We will make reasonable efforts to notify users by email before any major change or shutdown. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of South Carolina.
